Koby’s Cleanup / Outdoor Housekeeping — Terms & Conditions
These Terms & Conditions (“Terms”) apply to all Outdoor Housekeeping and related services (including dog-waste cleanup, pathway clearing, patio cleaning, weed pulling, salting, etc.) provided by Koby’s Cleanup / Outdoor Housekeeping (“we,” “us,” “our”) to the “Customer” (“you,” “your”). By using our services, you agree to these Terms.
If any term is invalid or unenforceable, the remainder of the Terms remain in effect.
1. Service Area & Scope
1.1 Service Area
We operate within specified ZIP codes / municipalities. Service outside our normal zones may incur travel or premium fees, or may not be available.
Qualifying Ohio zip codes: 44004, 44030, 44048, 44068, 44010, 44041, 44047, 44057, 44081, 44084, 44085
1.2 Scope of Outdoor Housekeeping Services
These may include, but are not limited to:
Pet waste removal / sanitization
Cleaning walkways, steps, driveways
Salting / deicing (walkways, porches)
Wiping / rinsing outdoor furniture
Trash bin cleaning / sanitation
Pulling weeds along driveways, fences, borders
Seasonal “refresh” services (e.g. leaf cleanup, debris removal)
Minor maintenance tasks agreed upon in writing
We do not include major landscaping (e.g. tree removal, major construction planting), structural repairs, or services outside the property boundary unless separately contracted.
1.3 Additional / Custom Services
If you request special or non-standard services not listed in your agreement, we’ll provide a written quote and amend the service order. These will be governed under these Terms once accepted.
2. Scheduling, Access, & Conditions
2.1 Appointment Scheduling
Services are scheduled in advance. We will not charge extra if we initiate the change.
2.2 Customer Cancellation / Rescheduling
You must notify us at least 24 hours before the scheduled service via phone, or email. Failure to do so may result in a “missed service” fee or loss of refund rights. If you are not present at the scheduled time and access is not granted, we will attempt to reach you; if we cannot within 72 hours, we may consider the service forfeited and non-refundable.
2.3 Access & Conditions Required
For us to perform services safely and effectively:
Please ensure clear and safe access to the areas to be serviced (walkways, gates unlocked, no obstructions).
The property should be free (as much as possible) of dangerous or sharp objects (nails, debris, holes, etc.).
Yards should not be excessively overgrown or obstructed—if we cannot clearly see or reach areas, results may be limited.
Frozen ground, deeply embedded debris, or excessively muddy conditions may prevent full service.
If you have chained/tethered animals or unsocial pets, they must be secured or indoors during our visit. We reserve the right to refuse service if conditions are unsafe.
We will not cross fences or boundaries we are not authorized to access.
2.4 Property Changes & Notifications
If you change property features (new hardscaping, structures, fences, water features) you must notify us ahead of time. We may need to inspect and adjust pricing or service approach accordingly.
3. Pricing, Payment & Refunds
3.1 Quotes & Pricing
You will receive a quote based on the scope, frequency, area size, and specific tasks. Once accepted, that price is binding unless you request changes. Additional work beyond the original scope will be quoted and billed separately.
3.2 Payment Terms
For recurring services, payments are billed monthly (or at the agreed interval) and are due in advance of the scheduled services.
For one-time or custom jobs, full payment is due prior to or at the time of service.
We accept credit card, debit card, and other online payment methods. We may also accept cash by arrangement.
If a payment fails or is declined, we reserve the right to suspend or cancel upcoming services until resolved.
3.3 Refunds & Cancellations by Us
If we are unable to perform the services due to our scheduling, equipment, or staff issues, you are entitled to a full refund for that service. In such cases, we will notify you as early as possible.
If service is canceled by you within the agreed cancellation window (e.g. 24 hours before), you may get a full refund or credit, unless otherwise specified. Late cancellations or no-shows may forfeit refund rights, at our discretion.
4. Liability, Damage & Indemnification
4.1 Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, special, incidental, or consequential damages. Our liability for direct damages is limited to the amount you paid us for the service in question.
4.2 Property Damage
While we take care to protect your property, accidents can happen. If damage occurs due to our negligence or error, we will repair or pay for reasonable damages as mutually agreed. You must notify us in writing within 24 hours of discovering the damage.
We are not liable for:
Preexisting property defects (e.g. weak pavers, rotted wood)
Underground utilities, irrigation lines, or hidden wiring that are unmarked
Damage caused by weather, flooding, natural settling
Damage caused by animals, pests, or third parties
4.3 Indemnification
You agree to indemnify, defend, and hold us harmless from claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from your breach of these Terms, your negligence, or acts of your pets, visitors, or property.
5. Term, Termination & Suspension
5.1 Term
These Terms remain in effect while services are ongoing. Each service agreement (e.g. for recurring or one-time jobs) is subject to these Terms.
5.2 Termination by Customer
You may terminate or pause recurring services with proper notice (via email, or phone) per the cancellation policy. We may refund unused prepaid amounts at our discretion.
5.3 Termination by Us
We reserve the right to terminate or suspend service for:
Unsafe conditions or repeated non-compliance with our access or yard maintenance requirements
Nonpayment or payment disputes
Animal aggression or safety concerns
Illegal activity or property conditions outside our service scope
Business or route adjustments, including the decision to stop servicing a geographic area at any time
In cases of termination, our obligations cease after proper notice. Prepaid amounts for upcoming services may or may not be refunded (see cancellation policy).
6. Dispute Resolution & Governing Law
6.1 Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
6.2 Dispute Resolution
Any disputes or claims arising hereunder shall first be addressed by good-faith negotiations between you and us. If unresolved, disputes may be submitted to binding arbitration or small claims court (if eligible), at our discretion, in the county in which we operate.
7. Miscellaneous
7.1 Changes to Terms
We reserve the right to amend these Terms at any time. Updated Terms will be posted on our website, and your continued use of services indicates your acceptance.
7.2 Entire Agreement
These Terms, together with any quoted service proposals and related documentation, constitute the entire agreement between you and us regarding Outdoor Housekeeping services.
7.3 Waiver & Severability
Failure to enforce any right or provision in these Terms is not a waiver. If any provision is held invalid, the remainder stays in force.
7.4 Insurance & Licensing
We represent that we maintain appropriate liability insurance and any required licenses to perform the contracted services. If requested, we may provide proof of insurance.
